Just a bit of lateral thinking. The league have deducted 10 points because SLH is inextricably linked to SFC.

 

If SLH is liquidated and the assets sold, SLH is no longer linked to SFC.

 

So what about the case for a deduction now, SFC survives still out of administration and SLH no longer exists.

Unfortunately I doubt it will make a difference anyway because we're dealing with a bunch of incompetent tossers at the football league.

As you are aware, the club itself is in deep doo-doo with or without SLH ... the deduction is proved to be a correct decision... and maybe more to come..

If SLH are liquidated, Fry will be administrating SFC directly. The deduction is then nailed on.

Just a thought! As SLH is no longer an entity, the assets are all being sold separately and the preferred bidder on each is being announced separately? The stadium was the first to be sorted because it has the greatest value and greatest debt, followed by the FC, followed by whatever's left. It could still be the case that the preferred bidder for asset 'a' is the same preferred bidder as assets 'b' and 'c'?

I find the amount of people currently logged in on the forum quite amusing. All waiting for that little snippet of info that will send us to the pub to either celebrate or drown our sorrows.

Either it will be wound up next week or it will survive.

 

To survive it will have to be taken over. It is not in administration, it would not need a CVA, the debts would probably have an agreed payment schedule with the creditors, who have taken their only option to keep the club out of administration.

 

In that case the football club would not have any connection with SLH, it's debts potentially paid and was never in administration.

 

What case could the league now make to deduct the points.

 

Liquidating SLH and selling the assets seperately would be atytractive as the shares would not have to be purchased.

 

The proceeds of the assets if any would go to the shareholders.

 

Staplewood and Jackson's Farm is worth about £2m, SMS is worthless, SFC is over £6m in debt, laying one off against the other and buying the debts for a peppercorn figure, would be the cheapest way out and the best deal for the creditors and the buyers.

Not quite. If SLH is liquidated, Frys job is done. SFC will be either on its own, or be calling in an administrator of its own.

 

So who then decides what to do with SFC when it has no shares or owners? The administrator.

This was posted in good faith that it had some legs, whether it came from 606 or not. I thought the idea of a forum was for discussions. And we all love a good rumour, MB and his damn text messaging better be the holy grail coming through some pretty thick mist!

Not sure if I should be optimistic or pessimistic at this moment in time... one of the guys here says other message boards (echo/606) are doom and gloom saying that the only buyer left on the table is only interested in the stadium. I guess they know as little as most of the people on here..

The only way SFC can survive is to be taken over. It's debts mean it could not go into administration so would be automatically wound up.

 

The creditors are letting it keep going in the hope it will be bought and they will get some or part of their money.

 

SFC could be sold for a £1 with the debts taken over.

Derry, unfortunately the key point is that the Football league is a members club that decides it's own rules / deductions etc. Frankly, they've decided to deduct points, and that's how it will remain.

 

The law doesn't really come into it. SFC (if it survives) could sue, but then the league could just revoke our league club status and we'd go under anyway.

 

It's anti-competitive really and wouldn't be allowed in any other industry but there we go.

But that wasnt posted as a rumour and you know that, it had quotes from Fry etc and you posted that on here without a link knowing who had posted that and where it had come from.

Well done you and Swanie had me going lets I just hope you are wrong and we have a club.

I think you might find they have breached their own rules and it is QC's who will decide any appeal on a point of law. Only time will tell, if there is no sale it won't matter.
