saintwarwick Posted 9 April, 2009 Share Posted 9 April, 2009 Hmm, Leeds were a club with a PLC as parent company when they went into admiunistration. Didn't stop the league from deducting them points in addition to the normal penalty. I wouldn't be quite so confident. But it was Leeds united that went into administration that is why they got the 10 point deduction, we have exploited a loophole and didn't put SFC into administration but SLH instead (whether you agree with it or not is a different story) and that is why the football league failed to give us the automatic 10 point deduction because we have not broke the rules. We aren't it's only the Plc in administration. If the creditors come to a deal with the administrators and new owners and the debts are settled and we come out of administration, in the meantime the club stays out of administration there is no case anyway. Remember Ipswich settled their £32m mortgage with NU for £7m and nobody sued them. Slightly different I know but it's business, just like SFC completing the transfers of Walcott and Bale by taking less up front instead of waiting for the staged payments, it's just business. mcjwills Posted 9 April, 2009 Share Posted 9 April, 2009 Everybody keeps saying that SFC is basically SLH but does not SLH own a company that owns ST Mary's who actually has the mortgage on the ground and they are in default for that, not SFC thus proving that SLH is definitely comprised of more than one company !! Just to muddy the waters a bit the mortgage is secured against future ticket sales. Isn't that a buggers muddle.
SFC Forever Posted 9 April, 2009 Share Posted 9 April, 2009 Whatever happens, as long as we have a club next season I will support it.
derry Posted 9 April, 2009 Share Posted 9 April, 2009 Also' date=' look at teh artiocal by Martin Samual the other day - the most telling is this - from teh Football leagues perspective - they want to deduct us points, and if they understood tehir own rules correctly and they were applicable it would have happened on Tuesady evening - the fact they have this thing going on is a desperate attemopt to try and circumvent their own rules loop hole - they may decide to do it, but watch the club take it to court - which could take some time and thats teh last thing the FL want - these things dragging over from season to season....[/quote'] Frank, Martin Samuel knows what he is talking about. He can see that the league having taken a weeks worth of legal advice KNOW their rules inside out. The legal enquiry is a political device dreamt up by Mawhinny to stop themselves taking a lot of flack from clubs and supporters. When the legal eagles find the same things as their own lawyers have already advised them, they will hold their hands up in mock horror and promise to make sure there will be no more loopholes. All the clubs threatening to sue are talking ******** and are just posturing, both the league and themselves know well that under their rules they cannot sue and have to comply with FA/league grievance procedures. Forgetting to mention of course that they and their rules and fear of being sued forced the plc SLH Ltd to set up a wholly owned subsidiary 'completely seperate' from the plc, so it could not sue them as it is subservient to their rules, unlike the plc which is subservient to plc law and couldn't be controlled by the league. Wriggle out of that.
hughieslastminutegoal Posted 10 April, 2009 Share Posted 10 April, 2009 I agree... but that is why I do not understand Wotte when he says that "we learnt that we would not lose ten points" ..... or that lawyer saying what he did The Fact of the matter is, until the League finish their enquiry, they will not know whether we have broken the Rules If we HAVE broken them, then we get docked 10 points THIS season, which effectively means Relegation IMHO, the League are just buying time, until the CCC fixtures are finished, rather than dock us 10 points NOW, thus leaving all concerned with no enthusiasm for the remaining fixtures ....... The League have NEVER said that any such points punishment would only be applied for the start of NEXT season Wotte said the admin issue had upset some of the players. Therefore whether points may or may not be deducted, it is psychologically a good idea to give players the hope that they could still play to avoid the drop. Therefore whether points may or may not be deducted, it is psychologically a good idea to give players the hope that they could still play to avoid the drop. But Wotte made the statement that " we learnt that we would not lose ten points " A catagorical statement He did not say "maybe", he did not say "as at today" How could he, or anyone else "give the players hope" ?? The LEAGUE have not made any decision yet.
