From what Ive heard Cortese is still refusing to sign the overall contract, is determined to have the architect removed and keeps adding to the specifications.

 

An initial contract was signed up to £1.5 million, Leadbitter have currently spent around 1.2 but wont put any more into it until Cortese signs on the dotted line. If its not done soon, Leadbitter will be walking away from the job...

Do you know what the initial contract was for and how much the total cost of the works is?

Yep, he does keep changing the goal posts which is annoying for all. He did similar at SMS for some refurb stuff in the summer, although that was small-scale so didn't take long to resolve.

If he changed the goal posts at St Mary's he should have made our goal smaller than the opposition's.

Most contracts allow the client to hold back monies for work done if thet are deemed to have not met the specification. /this looks like a normal construction dispute to me if not resolved the dispute clause probably calls for adjudication or arbtiration before court proceedings!

Its because we have no money, Cortese is the devil and probably has a lot to do with Reeds meddling or Adkins tactics

I suspect that Leadbitter are acting on a letter of intent with a maximum value of £1.5m. When that amount is nearing the amount of works completed on site, the contract really needs to be executed or they will just leave site. It's quite common practice, but most Employers don't c*ck around with contracts when they need to be signed.

I presume this means Leadbitter wont have been paid then?

No mate, they will probably have been paid, but there is a limit on the amount of work they can carry out. Of course they could chose to do more, but then NC wouldn't be obliged to pay anything over the amount stated in the LOI! But the longer it takes for the contract to be signed, the more uncertainty there is that Leadbitter will hang around waiting for the green light to carry on what they have started.

 

It seems strange that NC would question the contractual arrangements at this late stage. Generally speaking they are all sorted prior to starting on site, especially concerning something as fundemental as the appointment of an Architect. Usually the time gained by issuing an LOI is used to sort out minor issues and compile the documents, which can take a little bit of time. But of course any questions raised about Staplewood will be interpreted by the Corteserati as being anti-saints, anti-NC, etc, etc, so apologies in advance to all the monkey-spankers who think this post has an agenda.:rolleyes:
