Anyway, I thought that the forum had already assertained his innocence!

 

Seriously though, they say that eye witnesses have described 'seeing him launch the violent assault' to the jury. What's the norm here, discredit those witnesses or counter with defence witnesses accounts? Lee says that he has no recollection of the incident, so not saying that it was self defence or provoked but saying that he has no idea how either of them got injured.

 

I'm certainly not implying that I know better than anyine else, I obviously do not. I am however thinking that amnesia (genuine or otherwise) is surley not a good starting point as a defence of anyone's actions, this applies to everyday amnesic episodes, it may explain someone's actions or inactions but does not necesarily justify nor advocate tolerance of such.

Actually, is it not common for people who are found guilty by a jury of killing someone whilst driving under the influence of alcohol and/or drugs to be treated with leniency as the crime automatically becomes that of manslaugher?

No.

 

- Alcohol is normally an aggravating (not mitigating) factor in the case of assaults when it comes to sentencing.

- Unintentionally killing someone whilst driving (I assume you mean with the car ;) ) is neither murder nor manslaughter. It's death by dangerous driving, or one of the new variants - in fact I think there may even be a specific new variant offence of causing death whilst drunk driving. Anyway, they are completely separate offences to murder/manslaughter.

- Any murder be it by vehicle or otherwise would not 'convert' to a manslaughter due to intoxication. I think what you are talking about is Voluntary Manslaughte - this is when a murder 'converts' to a manslaughter, but this is in the case of suicide pacts, diminished responsibility, abnormality of mind, etc. Being drunk is specifically excluded from qualifying.

- Intoxication can be a defence (in which case, it wouldn't convert to a lesser offence, it would become no offence committed at all), but only in the case of involuntary intoxication. And obviously the burden of proof lies with the defendant.

Verdict: LB was probably acting like a **** with a load of beers around him. A cheeky tw4t acted like a c^nt and grabbed the beer out of his mouth. LB got Estee Lauder as a result of his bird with not much up top watching. Sentence: You're just like hundreds of lads your age doing the same thing every weekend, mind you geezah's a boxer and can handle himeself, nevertheless you're a tawt, and so are all the others who do what you do - 200 hours community service.

So drunk or otherwise, his amnesia will have no bearing on, not only whether he actually did assault the chap, the severity of any punishment should he be found guilty?

 

If someone can hurt someone in such a viscious manner and genuinely not remember doing it then one must ask if they are a danger to themselves and others if left unsupervised. A dodgy defence I'd have thought once that penny drops with the prosecution and more importantly the jurors.

Far more likely that they'll come to the entirely plausible conclusion that he can't remember because he was hammered. And that is no excuse for anything. Being drunk in no way abdicates you of your responsibilities when it comes to criminality.

Just seen the so called "victim".

 

He used to be a year below me at school - Bellemoor. He used to be a pWoperrr C*** as Danny Dyer would say. They type of c*** who walks around in a vest in nightclubs in Southampton giving it the billy big ******. But I'm sure the Jury will reach the correct verdict based on the facts that occured that night.
