I reckon they know they've pushed the UK Government too far. His appeal to the ECHR was based on the fact that he believed he would be tortured in the US prison system. Depends if you call guantanamo bay an area of torture (it is), or 30 years of solitary confinement torture (it is), or a possible death peanlty torture (illegal in the EU).
