Beat me to it....

 

Brighton and Hove Albion players questioned over sex assault

Six men, believed to be Brighton and Hove Albion footballers, have been arrested on suspicion of sexually assaulting a woman in the city.

Sussex Police said five men from Brighton and one from Dorset had been questioned about an attack in July.

The force said an 18-year-old man, an 19-year-old, two men aged 20 and one aged 24, all from Brighton, and a 20-year-old from Dorset had been arrested.

Brighton and Hove Albion Football Club has not yet commented.

Poyett will no doubt state it is a set up of some sort

 

And it probably is....how many of these cases actually come to court? I mean you could write a who's who of footballers accused of sexual assaults but most of them are just efforts to extract money from overpaid young men.

Maybe .. or maybe those overpaid young men can afford the best lawyers and have help from their club to wheedle their way out of trouble? Who can tell?

The thing that I dont get...is this bit....

 

Four of the men were arrested in Brighton at around 4.20am this morning (Thursday), a fifth, also in Brighton at about 7.20am

 

WTF did they think these were hardened criminals that it needed doing at that time? Not as if they didn't know where they would be...here is a clue...they are normally in the Falmer area several times a week.

Five Brighton players and one from AFC Bournemouth if Sky and the Mirror are to be believed.

 

I'm all in favour of dawn raids, for no reason other than it's massively inconvenient for everyone involved including the Police.

Diving, fouling and whinging on the pitch is one thing.....sexual assualt on the other hand....

 

I wonder if Gus will accuse the women involved of being a cry baby or something equally distasteful?

 

I had assumed he'd point out this sort of thing was normal in Uruguay.

The solicitors are going to have a field day handling the libelous remarks on this thread. Some people never learn. Perhaps adding smilies or something to show it's said in jest would be a good start to clean this thread up

there was a thread on the Lounge long before this one, it's just that there are always excitable people about who just can't wait to start new threads.Should get rapped over the knuckles every 3rd time that they do it.

The fifth was in Bournemouth cos he's just gone there.

 

In completely unconnected news, Steve Cook (defender) has only very recently moved to Bournemouth.

Attacked in July and the players are only being arrested now?

 

Probably have to build up a case, can't just arrest these high-profile people and then have them knocking about for ages while evidence and charges are brought up against them.

 

The answers are usually in the story.......

 

"they will be questioned in relation to an alleged sexual assault on a woman in July last year. This was reported at the time and the suspects were identified on Friday last week, January 13, leading to these arrests"

Just a word of warning to Danish and anyone else thinking of putting names to this, it would be quite a serious libel to misidentify someone. Of course it's just TSW, but it's been known to happen.

As a newspaper editor for the past 22 years I am offering this legal advice:

When someone is arrested by the police and taken in for questioning, we have what in our legal system is known as an 'active case'.

IF you discuss the case and arrests, circumstances, place conjecture or opinion in anyway publicly (ie on an internet forum, Twitter, facebook or in any written publication) you could be guilty or contempt of court, subjudicy and perverting the course of justice. These are criminal offences. You could be arrested, charged and if found guilty face a prison sentence; as could the owner and moderator of the website (ie Bozza).

 

Registered logged in users on NSC do NOT have an advert placed here

 

 

IF you name the people arrested (without the police or courts naming them first) you can be sued for defamation if the person named is later found to be innocent. There is even a clause of 'libel by innuendo' so the Buckaroo comments must be very careful. Take in mind these footballers are quite wealthy and their lawyers could well advise them to sue anyone who has named them as a sexual assault suspect.

I am now leaving NSC for a while, like a few others, while this all blows over.

The phrase 'active case' has no special meaning in policing. He's just made it up.

Utter nonsense.

 

The case only becomes sub judice (note correct spelling, which would be obvious to anyone with an iota of legal training) after someone is charged. A police investigation is obviously not sub judice.

 

Contempt of Court is, oddly enough, an offence against a Court. The clue is in the wording. As the matter is not in the hands of the Court, you would struggle to be found in contempt of one in any way, shape or form - let alone simply by posting on a website.

 

Perverting the Course of Justice is, oddly enough, when you interfere with a criminal investigation or trial. The clue is in the wording. Again. I can't think of how someone could possibly do so by posting on a web forum - unless they, for example, provided false evidence by doing so (and even so, they would need to back it up in the form of a signed and 'section nined' statement).

 

In conclusion, I'll leave it and tell him to f*ck off, I think.

 

(ps: if this is the quality of legal knowledge possessed by the print media industry, it's hardly a surprise they thought wholesale interception of communications was 'not that big a deal'...)
