If you bring in 400 then, if caught, I think that you get asked to pay the Duty on it, providing that you haven't been trying to conceal too deeply. It is up to the discretion of the Customs official. You are liable, I believe, to a fine and confiscation. Sorry, as a non-smoker I'm not sure which you mean, but I used to take the journey to france by tunnel or ferry 12 times a year, for 8 years, and I regularly saw people carrying bags with more than 600 (cigs) in them.
