Consumer rights advice

Pretty p:ssed off at the moment having just received an email today from a company i bought something off on Sunday evening. Just thought i'd consult the forum as you guys seem to have a good hold on these things.

 

Item was all paid for...including the £3.99 delivery which came up on the site as delivery cost...and as far as i was concerned that was the end of it...today i received this email.

 

Hi

 

Thank you for your order.

 

We will be posting the Luggage bag via DHL, the total cost for postage is £7.99.

 

We require payment of £4.00, we will send you a PayPal invoice for this amount.

 

As soon as we receive payment we will the bag sent out.

 

Hope to hear from you soon.

 

Kind regards

 

What a shoddy way to conduct a business! And also i suspect pretty illegal.

 

Any advice greatly appreciated. Well useful advice that is...

Before you get ****ty with them, check its not a website issue first. You might have selected the right postage but a problem with the website may have told them you chose something else... give them a bell

 

I may have already got a little ****ty!

 

And here is the reply:

 

apologies for the inconvience caused,

 

when you ordered the bag, you had been charged the incorrect postage.

this had been a technical error, the error has been corrected now postage for this bag is £7.99 on the website.

 

if we send out the bag for £3.99, this would not cover our postage costs for sending out the item via DHL.

 

The order had been in the shipping process yesterday, when it had been declined.

 

& we had been informed this morning.

 

I hope the situation has been clarified.

 

This is a company in england i hasten to add...although the language used certainly doesn't suggest that! Personally i would never dream of going back to a customer and asking them for extra money because of a c::ck up on my part...i'd just take the hit.

I'm no expert but I believe that a legal contract is made when they accept your payment.

 

In a shop, after they take your money, they must sell you the item at the original price. Not sure how it works on the web. if you paid by debit card, has the money been taken out?

If it has I'd think you have a good case.

 

Have a chat with Trading Standards - they're usually pretty helpful.

If it is an error, then the company can ask for the extra, but this would be a new contract. The purchaser has the right to avoid the contract. But he has no right to enforce it. Sorry.

Fair enough...cheers DSM...

 

I'll pay the extra...on reflection i don't really mind paying it as the bag is a bargain...

 

However as they are a preferred supplier for Jansport i may write a snidey email direct to Jansport after i've got my bag to let them know just how their chosen companies conduct themselves in the hope of getting some free stuff...

 

By the letter of the law they may be within their rights to ask for extra money...but i think it's an embarassingly poor way to run a business...
