Why should problems with other elements of the deal effect when the court case is anyway?

 

Surely you get the court bit done and dusted and then everyone knows where they stand.

 

If the Judge says 'no I won't allow you to sell the ground for £3m' then it doesn't matter a fook what the PFA will or won't accept, does it?

A court hearing to clear the way for the Pompey Supporters’ Trust to take over the club has been postponed for another week.

The News understands the Professional Footballers’ Association has withdrawn its support for the PST bid to buy Pompey in the wake of a rival bid being lodged by financier Keith Harris’s consortium.

Though the Football League has said Mr Harris’s bid was made too late in the day to be accepted, it is believed the PFA is urging the FL to change its mind.

Without the PFA’s blessing, the PST is unable to bid for the club, and Pompey’s administrators PKF has been forced to ask for another postponement at the High Court.

The case was due to go ahead tomorrow.

Portsmouth North MP Penny Mordaunt today brought the subject to the attention of the Prime Minister, saying: ‘Does the Prime Minister take a dim view of people who say one thing and do another, such as...purporting to support fan ownership of football clubs while undermining the community buy-out of Pompey, as the Professional Footballers Association has done this week?’

Mr Cameron told Ms Mordaunt that her campaign to help the PST take Pompey over was ‘very important’ and wished her well with it.

A source close to Pompey told The News that the PFA prefers Mr Harris’s bid because it would see creditors paid quicker.

Mr Harris and Portpin, which holds a charge over Fratton Park, have come to an agreement which would see Fratton Park leased to the club.

This would avoid the need to go to court to have the Portpin charge lifted, and therefore Mr Harris could be the new owner in a very short time.

The source said: ‘It’s not about the amount they would be paid, but how quickly they would be paid.’

The Pompey Supporters’ Trust said it would be releasing a full statement later today.

However, spokesman Colin Farmery said: ‘We have always believed community ownership is the best for the club, and we would hope the PFA would agree with us.’

A spokesman for PKF added: ‘Following the Football League’s announcement last week we continue to work with the PST as preferred bidders, and we continue to work on the court application.’

The PFA could not immediately be reached for comment.

Yeh I don't get this, the court case is to set the agreed value of Fratton park and to see if PKF can force the sale of it without Chinny agreeing to the sale price isn't it?

 

I can only presume that because Harris's bid negates the need for the court case then there is still a possibility that PKF can sell to Harris. This must be on the basis that the PFA can twist the League's arm about what it said last week.

I think the court case has 2 questions to determine : (1) what is a 'fair' price for fatpipes ?, and (2) can the preferred bidder afford it ? It would be lax of the court to say that the selling price should be fixed at £3Mill if the PST can't meet that, ( despite being 'fully funded' ). It seems that without the PFA's agreement to further deferral, the PST cannot pay the 'fair' price.

Can someone remind big adam that no-one is standing up and saying 'those poor footballers', they are infuriated that not only have 'good ol' pompey' not paid any money owed to any creditor (despite the heavily reduced sums) through two admins, and they continued to not only 'pay' transfer fees they couldn't afford, they are now trying to justify not giving those players the wages they earned during matches to keep them up/down!

 

They bang on forever about the need for fairness and keeping integrity by being 'competitive', but they shaft all creditors to do it, then don't pay up anyway. This is ALWAYS ignored by journalists, broadcasters and political figures, leading the blue few to feel like they are justifed in their whining, which pays their pathetic mewling over being 'punished for the same crime twice' and 'punishing the fans, not the criminals' even more detestable! What they actually mean is they have been given lenient points penalties, which have yet to may any impact on their survival in the instances it has occurred.

Yes, footballers are rich and most can afford to take a haircut on what they're owed, but that's not the point. The Football creditors rule is there to ensure that clubs don't go round buying players that they cant afford (don't laugh). How many other clubs would do a Pompey if they knew that they only had to pay players X amount in the £ if it all went tits up. If there's no football creditors rule, what's to stop clubs buying players and knocking the selling club? Selling clubs would then be forced into admin, because other clubs had refused to pay. It would be like a house of cards with one clubs admin bringing 5/5 clubs down with it.

I think the case is actually to allow PKF to force Portpin to accept £3 million (now) as payment for its (£18 million) charge over Fratton. So the case cannot go ahead if PKF are not in a position to give Portpin that £3 million within a short time of the decision, and of course PKF are relying on the trust to give them the money as part of the overall sale, so if they haven't got the money to hand, PKF cannot force the issue.

It's like a Sunday Ref trying to give a team time to equalise at the end of a match, but it's looking more like they'll concede at the moment.

It seems the wheels of Chainrai have been working overtime on this one. Chainrai's links Andronikou and his with Tal Ben Haim's agent are well known so we can surmise that the pot of disquiet has been stirred amongst the ranks of past players to whom monies are owed.

Full marks to Penny for getting the first public strike in. Now it's up to show our fury en masse.

Actual statement says it's £2.5M in escrow from fan pledges AND individual investors.

 

They're barely covering just the missed £2M even with the HNWs.

 

As for the loan, it's still subject to the same conditions (so not actually handed over yet.)

Basically, they're in exactly the same position as yesterday, except now they've got the extra hurdle of the PFA to get past.

 

The PST is using more spin than Shane Warne at the moment.

Serious answer. Their attedance figures in L2 ought to be enough to comfortably support a L2 club. However , on top of all the normal expenditure, they will have to generate enough gross profit to pay back the loans they are relying on to take over. So if for once they are to be run sustainably, they will have to keep wages low, right down with those paid by the likes of tiny clubs such as Aldershot etc. This should mean they cannot expect to assemble a team that will easily get promotion. So unless they get lucky, apppointing an excellent but cheap manager for example, they will need to make do with being mid-table L2 for several years to come.

 

Once they've paid back the initial loans in say 5 years time, if they've not been tempted to put themselves in hock in some other way by then, they could then start to spend a bit more, and ought to be able to get up to the natural level for a club of their size .... probably yo-yoing between L1 and championship IMO.

 

Cheers. That's if they survive next season in League Two of course... Plenty of teams have been relegated from League One only to struggle the following season. If there's no improvement from their team, they're destined for non-league.

That's a quote from Trevor Birch. I thought his job was to do the best deal possible for the creditors. Not the club but the creditors. If that means the club loses its golden share then so be it. How can he justify, therefore, 'ploughing on with the PST' when he has confirmed the Harris deal is bet for creditors?

So on the same day the skate council announce funding cuts of £9M, they also approve a loan to those cheating bastards. Couldn't make it up.

Speaking to a Skate supporting colleague today. He does actually have a sensible head that he wears and as a welathy businessman, does have strong links with Trust members.

 

His words to me were; "I've paid my thousand pounds but the Trust hasn't got the money. Birch will only sell to the Trust if they have the money and he's giving them every chance, which is why there have been these adjournments (he was obviously unaware the PFA had caused the latest one).

 

"But I think it's getting close to the end. Birch has asked Ashley Harris if they have the money to go immediately, and Harris told Birch he could not put his hand on his heart and say in all honesty that they have."

However, this time, his aim is to save a particular specimen of fish for future generations of Portsea Islanders and honour one of the Pompey greats.

 

The splendid edifice will be known as.. Cala's Multi Storrie Carp Ark...

I also LOVE how they are bigging up penny the belly, for calling for the PM to condemn the PFA for 'promising one thing then doing another'.

 

The fact that the PFA were promised one thing than told another after the agreement was made, seems to have gone over their heads (unlike a sticky bun, she would have reached up to grab that).

Not sure how PST can say that PFA members wil get diddly if pompey go into liquidation - I thought the PPs would go traight to PFA in that case anyway?

 

So obvious that for the PST bid to work they need to get the PP payments as cash - to underwrite the Council loan (possibly why coucil solicitor is requiring adjournment as risk has increased if PFA not going to gove up PPs)... in effect using some to buy stadum and some as operating cash with football creditors being paid a reduced amount on a reduced amount for them to survive....

 

Now correct me if I am wrong, but surely whether the football creditors accept less once, twice or 3 times should be irrelevent. The SPIRIT of the rule is they should be paid in FULL. Because those players who turned up at pompey gave them an unfair competitive advantage and would not have turned out for pompey had they known what little worth their contracts were - even if they agree to now acept 40-60% it should make feck all difference, They still benefitted from players who would not have signed under the current compromise. players better than their competition was able to afford and all we hear is this constant frickin bleating about how unfair it all is.... THAT is why I have no sympathy, they simply DO NOT get it - This can only lead to the conclusion that they really ARE ALL thick as shiedt down that way - because its not jsut jingoistic fans, but 'journo's, MPs and councilors... none of whom have demanded that the simple acknowledgemnet, that if they want to come out of this with any integrity, they MUST frst stop trying to constantly get away with not paying anyone.... they have done thsi for the last 5-6 years and look where its got them... how the feck can that fat MP say those things... complete lack of integrity.... fits right in with that crowd donw there.

 

I think if a club is due PPs and is liquidated anything outstanding is divided between the clubs.

It won't matter who is in charge down there, they do not expect to need to be able to play by any kind of honour, of rule, or even common decency.

 

All must be subservient to the football club, the tax dodging, cheating, self righteous football club. Vermin, they truly are vermin, regardless of ownership.

I would have thought that if the administrators job was to get the best deal for the creditors he should have wound them up some time ago when there was not only the asset of the football club, but players to sell and future Pp's. surely that would have left 10-20 m in the pot
