So Baker Tilley offered Birch £4.9m if he agreed to advance them £119k to use to chase it? While that sounds like some sort of Nigerian scam, if I were a creditor I'd be expecting an explanation of why Birch didn't bother to pursue that £4.9m and has now lost the right to ever obtain it. Although of course, if the Gaydamak land and NewCo happened to end up in the same beneficial ownership, then that would be meaningless and any legal costs would have just been money down the drain.
