I think a lot of the Pompey Knocking that has gone on over the last couple of weeks on talkspoort etc is mis-placed.How can you legistlate for an owner being knicked due to iffy financial deals?? Which inturn effects the companies he owns??.Surely nearly every other club in the land would be in the same boat with the same chain of events.No one is to blame for whats gone on this time around in my view other than the CSI guys[/TD]

Not sure. The bit I am unsure of is who decided the size of the pot that going into paying the CVA. If its just what the administrator can get away with persuading the creditors to accept then I assume there is little difference between paying the football creditors 100% and other creditors 20% at the CVA compared to paying all creditors 20% at the CVA and then the new buyer paying the remaining 80% of the football creditors. In both cases the money needing to go out to pay them all will be the same?

Point 17 says :-

Neither section precludes payment of non-preferential creditors by third parties ahead of preferential creditors out of their own free money, and accordingly there can be no objection to payment by the Buyer of the Priority Debts in full. It does not matter that the non-preferential debts are paid (as they are paid in this case) to discharge the debts of the company and accordingly "on behalf of" or "at the instance of" or "for the benefit of" the company by a third party if they are paid out of his free money and at his own cost and not at the cost of the company. It would of course be different if the company put the third party in funds to do so. It would be different if the Sale Agreement were a sham or device adopted to disguise payments by the company to non-preferential creditors ahead of preferential creditors e.g. by agreeing an artificially low purchase price payable to the company for its undertaking in return for the assumption by the purchaser of an obligation to pay non-preferential creditors.

 

IMO the Football Creditor Rule has become a "sham or device adopted to disguise payments by the company to non-preferential creditors ahead of preferential creditors."

The way I read it, HRMC are trying to get the football creditors rule changed so that ALL debts are EQUAL!

 

This means the FL can still impose their 'all football debts must be paid in full rule' to receive the golden ticket, but by implication this will mean that ALL debts must also be paid in full as their will be no preferred creditor status.

 

So, a CVA would have to state all debts 100% paid. Which would render administration as quite literally a pointless exercise.

I have Radical soloution to the Football Creditors Rule - How about the FL set up Debtors League, one where teams that default on football debts are placed and they play each other. Any prize money from competitions is controlled by the FL and only when they have cleared all debts are they allowed back into society! And then intoat best L2 additionally no trophies would be awarded for winning the Debtors League, this would prevent adding to your fraudulently aquired a glorious history!

All this quietness has to be good news.

 

TB seems to be doing a proper administrators job and there is still no a sniff of a proper buyer, only talks of an unlikely fans buyout.

 

Selling thier youth (magri), recieving forwarded PPs and loaning out first teamers just to see them through till the end of the season means they look less sellable with everyday that passes. They don't have a ground to sell (brighton), no players that will make them much money in the tranfer window and a huge wage bill. If no buyer comes in very soon they are doomed.

 

I think liquidation would be good for them, otherwise they will never be able to clear their debts and will have to take drastic measures ensuring the shame of relgation after relegation. No fan wants to see that happen to their team. They will probably end up in the conference still with a large debt to pay and going no where! Liquidation means clean slate and with a fan base such as theirs, they can immediately look forward to years of promotion battles.

 

Lets hope they don't liquidate ;)

The answer to the creditors rule is simple if teams try and ditch their debts by going into admin. Withdraw the registrations of players who are not paid for until a new agreement is contracted to pay off the original transfer fee post administration. Allow no new players to be signed until that happens.

AFC Wimbledon technically (although many may feel otherwise) aren't a club replacing one gone out of existence, they are a protest club (with MK Dons still existing) so had to start lower down the leagues. Any new Pompey team would be a replacement and so will likely be treated differently as talks between Pompey Trust and the Conference have suggested and like they also did when some Saints fans looked into this eventually if required for Southampton in 2009.

Indeed. AFC Wimbledon who the FA believed were 'not in the wider interests of football' helped clubs in the Combined Counties League stay afloat, simply because of the huge numbers they took to away games. I went to see them play Dorchester and they could have had a whole stand at the Avenue to themselves if segregation was in force, and believe me, it's a fairly big stadium for that level.

 

If an AFC Portsmouth were set up they should begin in the Sydenhams Wessex League, local derby with Moneyfields etc.

The question you have still refused to answer, is what would attract a serious buyer to your scummy club! No training ground, you don't own the stadium, you don't own the surrounding areas, so what is the attraction?
