Pompey Takeover Saga

George Gavin, Football League Weekend: 'It's hard on the players because they've won those points, so it's unfair to have them taken away'.

'It's hard on the players because they've earned those wages by attracting record attendances and healthy profits, so it's unfair to have them taken away. Oh'

think they will only get -10 as previous deductions seem to be for either exiting admin with no cva or not exiting admin before start of new season.

grrrrrrrrrrrrrrrr

IIRC, the Football League rule book has a "These are the rules but we can make up other rules as we go along" clause in it. So, anything is possible....in theory....

But did anybody want them ? If they were wanted and were holding out for big wages then they have really messed up with their wages being deferred to keep the club going.

Therein lies the problem.

Pompey's wage structure after the last admin being too high and tempting players who other clubs would offer and pay less to.

Apparently a text conversation between a Pompey fan and AA this afternoon:

Carl Paddon@CarlSpangled

Here we go - you will have to bare with me as I will put it word for word.. I txt Andronikou first by keeping simple

The first txt was hahahahahahaha the 2nd one was you're now a laughing stock....

He replied, oh really, you should be laughing. Hmrc have their man and we'll see what happens to the club. Fool!

my reply - your track record against Mr Birch isn't really worth comparing, is it?

I continued to say, regardless of what happens to Portsmouth Football Club, you're not going to be part of it. That is a very proud moment.

His reply - you're an even bigger fool than you sound then.

My reply - like you said, let's wait and see.

His reply - I hope I'm very wrong.

My reply - you were wrong about overcoming the challenges today, wrong about Cala, wrong about what you've said about Chainrai, let's face it you've been about a hell of a lot I haven't even talked about Swindon yet???

His reply - wrong about Cala?? Who showed him the door?? If it wasn't Chainrai you would if disappeared and as for Swindon, they survived 2 admins with me so get your facts right before you talk rubbish...

My reply- its all about reputations in your game and you haven't got a very good one. FACT! What did Mr Birch say about working with you - No thanks and as for Chainrai. Hahahahahaha

His reply was - Birch didn't want to work with me because he knows I want to save the club and hmrc want to make a point you fool. Any simpleton could work that out. Good luck and good bye........

My reply - you're not interested in protecting the club, just your friend's pocket. Have a great weekend, mine will be massive. As will many others....

He replied, good to hear and your wrong... I replied, its there for all to see Andrew... He replied, believe me, you're very wrong......

My last txt to him which he hasn't replied to was How can I believe you when every time you open your mouth, something different comes out Very much like Chainrai and his statements of intent or more like lack of.. As I said people he is yet to reply to this one.....

Since the previous CVA has been reduced without the creditors agreeing to it, they've failed to exit the previous admin via the agreed CVA.

I reckon the total points deduction heading their way could well kill off any remaining interest from buyers.

Or....they were under instructions to say that they didn't want to leave....perhaps....?

The story I heard was the players wanted a move. But portsmyth were in such dissaray the was no-one at Fratton that was able to make a decision at the time.

Tony Husband said on South Today that the debts were £4k. How can a journalist not know about Baloos, Gaydamak, CVA and CSI's debts when they have been highlighted for him so many times on this site.

I think its £4m of outstanding bills/wages then the other debts on top.

Luton town must be going mad. I know what they did is slightly different, but I'm sure if anyone had the real guts to look through Pompey's books there would be as good a ground as any to hit them with -20 at least.

Watch the bastards now survive and get a new owner, and come through this stronger. It shouldn't be allowed, but for some reason the authorities just don't want to punish them.

it may not be over...this may be (hopefully) just the automatic going into admin punishment...they may meet (FL that is) to discuss further penalties

Exactly - this from the BBC Sports page@

And, although Pompey are set to be docked 10 points for going into administation, they could lose further points at the discretion of the Football League as a result of it happening for the second time in such a short period of time.

Leon Crouch and Mary Corbett stated at a meeting I was at, that we couldn't go into administration, as soon as the club ran out of money it was only liquidation that could be considered. And that was very close. We had run out of time, it was either ML or liquidation.

I was there!!!......Also to hypochondriac, Le Tissier was the front man for Pinnacle so of course Nicola would put some of the blame on him.

Thats not nice -10 points and nasty comments, terrible, terrible.

Don't worry my little cherub. I'll give them a severe talking to and a spanking if necessary for being so cruel and heartless.

These arrogant SWF hoodlums need to understand and appreciate that they've already extracted a huge amount of pleasure out of the plight of your once proud football club.

I say: Enough is enough!

Rest assured I shall have words, especially as there is probably at least another 6 months of hateful humiliation coming Pompey's way.

Have some compassion for this poor lost fellow my fellow SWFers.... FFS!

I was going to provide a recap of previous deductions of more than 10 points, but Jesus there's some complex stuff out there.

So here's Nick Owen off 80s telly to explain Luton's -30 in League Two (on top of their previous -10 for Admin that sent them down from League One in 2007/8 ). http://news.bbc.co.uk/sport1/hi/football/teams/l/luton_town/7438024.stm . The deduction was before the 2008/9 season started.

Leeds' -15 was for exiting admin without a CVA (all Ken Bates' doing), http://news.bbc.co.uk/sport1/hi/football/teams/l/leeds_united/6920103.stm - widely regarded as being the FL's way of getting back at Leeds as the -10 rules as they stand now weren't in place and they dodged the original -10 by going into admin when already in the relegation zone in the last week of the season : http://news.bbc.co.uk/1/hi/business/6624731.stm. It was those fckers we had to blame for the deferred -10 which delayed our return to the Championship, as they changed the rules soon after. Leeds appealed the -15 and eventually an arbitration panel supported the FL.

Rotherham in 2008 were deducted 17 points - like Leeds this was at the start of a season, again for failing to exit admin with a CVA - as HMRC were voting against all CVAs at the time, and still are, as they refuse to accept their new non-preferred role behind football creditors. http://news.bbc.co.uk/sport1/hi/football/teams/r/rotherham_utd/7543195.stm

AFC Bournemouth were also deducted 17 points at the start of 2008/9 (alongside Luton and Rotherham in League Two) due to having a previous insolvency within 2 years and for not having an agreed CVA. http://www.dailymail.co.uk/sport/football/article-1042684/Bournemouth-start-League-Two-17-point-deduction.html

So basically what it looks like, is that Skate Cheats FC will get a minimum -10, plus whatever the FL decides to add to that - the areas in question are :

Will the FL wait for them to exit the CVA for any additional punishment or has it been coincidence that the last 4 punishments over 10 points have happened in the summer ?

and

If even they have an extra punishment soon for their repeat admin, they could still get further punishment on exiting CVA, especially if HMRC aren't marginalised, as they are currently a big chunk of the debt. Assuming they get that far. Oh yeah, and they'd better hope none of their ex-money men own up to any irregular payments...

I was thinking if it's only minus ten we might get the chance to repay them for their cheating at West Brom to send us down, seeing as we have conventry last game wouldn't it be great to loan cov barnard and then depending on our situation throw the last game of the season against them?

-10 is not justice. I hope they are forced to use all of their players including their kids.no loans and that they get anilhilated every game and that we put 10 past them !!!t

If you had put "I'd love it" in the comment i would have been convinced it was keegan. hopefully, now they have unfairly docked us points and unfairly frozen 'our' money and unfairly not been vigilant enough when checking on our prospective owners they will allow us to pay/borrow the wages for a couple more loanees to come in, it would only fair. otherwise how can we be on a level playing field with the other teams

Terrible

Nothing on the FL web site to suggest they are even considering more than a 10 point deduction for now. As others have pointed out pretty much all the precedents for greater penalties show those happening at the start of the following season if admin hasn't finished 'tidily'

You mean like the level playing field when you were paying big fees and wages that you couldn`t afford/sustain to buy "success" that started the whole train crash off. Not unfair then was it?

Think I agree with this (sorry I was watching Falling Skies on Catch up so prob 4 pages behind)

I think they have done the automatic, but just get the feeling they might do a Swindon and relegate them 2 divisions at the end of the season.

the FL Management Committee may defer a decision and put it to the entire League members.

Strangely, I also think that is their best chance of actually becoming a Community owned club. The very last thing they need right now is another dreamer. Trevor Birch will probably be able to use Google unlike AA
