What are the chances of an adjournment on the 20th?

 

The only scenario we could come up with is that AA as usual finds a buyer introduced by BC that will save the club in 48 hours

 

Do winding up petitions ever get adjourned without the bill being paid?

 

I suppose HMRC could withdraw the petition? But Hmrc don't do that.

 

Surely a winding up petition is not the beginning of the end. It is the end. A guillotine on a bad debt junkie business.

They got an adjournment at the first Court hearing with HMRC last time, 2 years ago. 14 days I think it was, for them to come back to Court with more than just Pete Mate's "back of a fag packet" estimate of the value of his squad of players, and to come up with actual proof that they had access to funds to continue on a solvent basis and pay the arrears to HMRC, rather than just that the knew somebody who had loadsamoney. I think it was called a "Statement of Affairs".

 

Chainrai put them into admin before the 14 days was up, so they didn't get back to Court for the WUP to be resolved. The purpose of the hearing is for the Court to either convert the WUP into a WUO (the guillotine you refer to) or not.

 

It was a risky strategy last time, and would be much more so this time round if they went to Court on the 20th expecting to get an adjournment.

 

However, if they (AA & Chainrai) have no other plan, and actually do end up in Court on 20th, they will certainly ask for an adjournment, to give them time for AA to tie up the loose ends with the latest buyer. HMRC will probably oppose, and it will be down to the Registrar to decide.

 

Others will probably disagree with me, but I think it would be nice if we got Christine Derrett again.

 

My gut feel is that if admin again is actually a viable option for them, they'll go for it before the 20th.

Just to add to the humour of the situation, yes it would be nice to get her again. I think her suspisions of trading while insolvent were well founded and wonder whether 2 years on she'd give them the benefit of the doubt again.

The possible point it overlooks is that the fratton Park site, especially if added to his enemy Gaydamak's land, is worth quite a bit for non football purposes. The planning guidelines would be relatively easy to overcome ..there are many instances of this .... So maybe Chainrai is actually looking for liquidation now as the best way to recoup most of his money.

Article in DT today that HMRC will not put up with delayed payments of Tax & NI from next April. If it looks that a Company may have difficulty in paying over monies it has collected for this, HMRC will require a Bank Bond or Cash deposit to cover. Failure to provide when asked, will result in £5k fine.

Don't worry love, the date is already set, and HMRC are looking forward to it more than pompey.

 

As for the other MP's government should buy fratton park nonesense - just a desperate attempt to hang onto votes as the ship sinks.

I told them to buy it but they wouldn't, poor us, everyone else's fault etc

Haven't Sport England got a few (million) more worthwhile projects to spend their money on? Ah yes:

 

Sport England is committed to the creation of a world-leading community sport environment. This means focusing our investment on organisations and projects that will grow and sustain participation in grassroots sport and create opportunities for people to excel at their chosen sport.

 

Now if only Pompey had an academy worthy of the name they could claim they were doing just that. Whoops.

 

It's irrelevant anyway, Sport England won't touch that lot with 20ft pole.

The latest article in the News about Government Plea to Buy Fratton Park tacitly admits that the ground could be used for other purposes:

 

The letter sent to Sport England said: ‘The council has effectively secured the ground from alternative investment, but the risk remains that access to the ground could be restricted while ownership remains unresolved.

 

As Ken Tone says, it would be difficult to oppose a genuine alternative use for the land if PFC go under as the Local Plan is only guidance.

Oh FFS, they really need to just f*ck off and die now, this is taking ridiculous to a new extreme.

 

Do they not see that they are no different to any other club in the FA? It would be a national scandal if government/taxpayer funding was used to not only buy a financial black hole of a stadium which is nothing other than a liability, but also the fact that our money would be going to a viscious loan shark operating in a tax haven - it would be utterly disgusting and it simply must not happen. It is absolutely unbelievable that these MPs and Council persons are making such frightening claims, vote winning or not - they must know this is plain wrong.

 

So how many other grounds will the tax payer have to fund if poopey blagged it? Its about time FIFA intervened here and reminded the poopey politico that they are threatening the integrity of the game and political intervention is not acceptable in football. FFS

They will provide the most amazing showcase for sport in this country, and by the time they're finished overseas investors will be queuing up to get a piece of the action, even if 'the action' is a club as wonky as ours. All we need (and Chainrai is no idiot so he'll realise this) is enough funding to keep the taxman sweet and pay players until the end of the season. It will cost him a few million, but I reckon that by the end of August he'll be able to slap a £50m price tag on the club and someone will pay it.

If that example of court justice is anything to go by, pompey will comfortably trade their way into the play-offs.

 

Its a Dog world, but we knew he would wriggle out of it. At least we had some good laughs along the way, Rosie, arry screaming 'stop staring at me' to the detective, arry cant read/write/text/spell, arrys like a 2 year old, fans up and down the country cracking jokes via social media... and all of this happened on pompeys watch - another courtroom stain on the DCFSBs.

 

It does seem football is above the law these days, unless your a Darlo, Scarboro etc in the lower leagues.

 

 

So, on to our next court case - Pompeys latest WUP... currently being lobbied by corrupt MPs and Councillors, with HMRC being undermined at every step despite being shafted by £30m just two years previous... The Dockyard crumbles whilst public servants continue to seek a cost negative solution for a tax payer skate bailout.

 

Is it time we all write to some journos, and try and get some momentum going in HMRCs favour? If people could list some I will send off some beautifully composed and neutral letters this evening - it will be my pleasure, we need to find justice and we need greater exposure beyond the BBC website and the snooze.

It can also now be reported that Mr Mandaric and Peter Storrie, Portsmouth's former chief executive, were cleared of tax evasion charges at a separate trial last October.

They were both accused of evading tax over player Eyal Berkovics's termination fee.

Mr Storrie was also accused of dodging tax on a signing-on fee to midfielder Amdy Faye when he moved from Auxerre to Portsmouth.

 

Mr Storrie, who is now allowed to speak about his trial, told BBC News: "We said from day one that it [the case] was farcical.

"I am delighted we've been proved completely innocent and I can get my reputation back."
