OldNick Posted 25 June, 2009 Share Posted 25 June, 2009 What's the legal position of players contracts if the Club defaults on salary payments? Can the contracts become void in this instance? In which case could they walk away to a new club without SFC receiving an payment? This really would be trouble leaving no assets for Fry to sell to pay off the creditors. I dont know but that is a concern. If we breach contrats then I expect then the players could walk. The ones of any value may well take that option up but the ones who are not will sit tight and wait. Worse case scenario is starting to unravel, bgut agian there is still time for a star to appear.
Gemmel Posted 25 June, 2009 Share Posted 25 June, 2009 As an earlier poster has said - I am going to remain positive for today, so with that in mind, the staff not being paid, can work in Pinnacles favour. The football leagues actions or stance is now directly affecting the livelihoods of people working in the game and the club now has a real possibility of folding. It is now in their interests to do what ever they can to help, whilst at the same time keeping face and seen to be fair to other clubs that have suffered the same fate. I note with the interest that Pinnacle appear to be the only ones talking with the FL. If mj was serious he would be all over them to try and understand exactly what the issues are, as they would be the same for any buyer.............. you can bet your house on it that if mj's lot were talking to the FL , he would have told the world. So Tony Lynams pitch, is for one small concession (Whatever that may be) the FL could save the jobs and possibly an entire club, by helping us out. Without that help, people wont be paid along with their mortgages , bills etc and that is as a direct result of the FL actions

Gemmel Posted 25 June, 2009 Share Posted 25 June, 2009 Why is it the Leagues responsibility if the club has been mismanaged? I didn't say it was. The point i was trying to make is that livelihoods are at stake, as is the existance of a football club. The football league, can with a single stroke secure the employees, the club and the fans future. Small leverage may be, but leverage non the same. This is the most important issue in my opinion. We're talking about people's livelihoods. They have mortgages to pay and children to look after. Either get the deal done, or put them out of their misery. Puts 'brinkmanship' from all sides into perspective doesn't it.

Chez Posted 25 June, 2009 Share Posted 25 June, 2009 Why is it the Leagues responsibility if the club has been mismanaged? You have a club, one of its members falls ill, cancer perhaps, the member was a heavy smoker and that was the cause of the cancer. Does the club tell the member to **** himself as he should not have smoked in the first place or does the club board do its best to help the member back to good health knowing full well they are not going to smoke ever again? Window Cleaner Posted 25 June, 2009 Share Posted 25 June, 2009 What Player Bonuses? End of contract, loyalty, whatever ,probably on a year completed basis. Plus I don't know about Uk specific cases but in the majority of EEC countries if your employer pays you after the set day then he is liable for any charges (or loss of reputation) that his tardiness causes you. If your credit rating goes down because of his insolvency then you can sue him for damages. Anyway the only thing that can be said to describe the whole business is f*cking shambles. "We'll be ok", "Keep the faith", "Jan's got them passing really well, we won't get relegated" and words to that effect. I, along with many others, knew we were f*cked as soon as Lowe and Wilde came back and rid the club of Pearson. Point proven. Now, we are seriously stretched in admin. and time is not on our side with this takeover stalemate but it's all terminal according to most and now, apparently, there is no hope of this deal concluding. EVIDENCE? Just wait until the end of the week, then you can be happy Pinnacle have failed (as you seem to heavily infer). You used to wear rose tinted specs when we were getting trounced week in, week out under Lowe's Dutch duo and youth team of injured loans that no-one wanted...try having some faith in Lynam, Le Tiss and Pinnacle. They may just conclude a deal before the week is out (or is that too optimistic for the Deal or No Deal viewers who smile, clap and deludingly insist it's alright that they've just thrown away £250, 000. Or, £500, 000+ if you're Pinnacle). Luckily, I don't think Pinnacle are that stupid, deluded or naive. FFS, it's astounding.
