Or, have the club got enough money for next Thursday. There was something on here about Rasiak? Poland? and you getting £200k, and maybe other bits I've missed? Nexstar Posted 22 June, 2009 Share Posted 22 June, 2009 where in the statement does it say anything about refusing to allow an appeal? "The Board of The Football League met today to consider representations from the 'Pinnacle Group' with regard to their proposed takeover of Southampton Football Club. "The Football League has the responsibility to ensure all League clubs start the season with certainty as regards the competition they compete in. "With that in mind, The Football League has responded directly to the Pinnacle Group, and will continue to liaise with their representatives going forward. " Means that they won't allow an appeal because, if successful, it would mean moving up the league table and ahead of other teams.

Boris Karloff Posted 22 June, 2009 Share Posted 22 June, 2009 Reading in between the lines of their statement, is there something more to it? Are the FL worried that if we won an appeal we could then claim that the announcement of an incorrect points deduction at such a sensitive time of the season destabilised the club and contributed to our relegation. Is this what they are worried about?

They arent going to change them for a medium sized club like Southampton Just do the deal FFS - if this benefactor isnt Barry the Builder then we ought to have money to get a squad to cut that deficit quickly. Look at Bournemouth It is a legal and moral right to have the right of appeal. its the process that allows to either correct an unjust decission or confirm a just one. If the league have been correct and just in there decission to give us a points deduction then an appeal should show that and they should have nothing to worry about. The only reason I can think of for them not allowing us an appeal is if they think they made the wrong decission in the fist place. That, if proved would open up all sorts of legal debates so I guess the league will either stand firm or look for a resolution that has no follow up legal action. If they stand firm I wonder if the club has the right to go to anyone else to take action against the league? In work it would be deemed as constructive dismissal and there is action that can be taken. In a private members club we might be stuffed though. So both parties think they have a winning hand and niether want to call.

Just don't want to hand over the dosh till the last second me thinks! Fair enough they new the -10 was there but they also undersood that there would be the right to appeal. the club think they have a good case to apeal so are planning too. when they get to the take over point the league ask them to sign over there right to appeal in exchange for the ticket that enters them into the league. Doesnt look like Pinnacle are trying to back out TBH.
sidthesquid Posted 23 June, 2009 Share Posted 23 June, 2009 What I still don't understand is how Mawhinney clearly said to the world that we could appeal the deduction when first imposed on us, and now they are making it a condition of giving us permission to play in the league that we promise not to.
