Obviously I know nothing about your situation SO16, but I would very strongly suggest that you'd be better off in the long term to keep the house and in 3 1/2 years when you're free of the IVA and still own your own family home you'll be delighted that you did.

I always found XBMC (via Raspbmc) quite creaky on the Pi and not entirely reliable - it would often hang or lose network connectivity. I have none of the issues with the Pi2 (although it should be noted I'm now running openelec on it) and it's quick, slick and very reliable. As for power consumption, I'd suspect you'd need to get yourself a decent power supply as the Pi2 is a good deal more power hungry. Very much worth it though imo.
