Saint in Exile There should have been a proper investigation and due process should have taken place . Your lad is not working at The IOW branch at Newport is he ? I would have thought after the Pritchard case , B&Q would have ensured their store managers were better trained in disciplinary investigations etc. The Pritchard case , the out come was harsh but found to be fair. I previously read the the tribunal case notes a couple of years ago while advising on a potential dismissal case . Anyway Send me a pm or I can send you my email address. Hi Saint in Exile. I have read your post re your lad, I'm a little astonished by B&Q's response to this situation as they are pretty ofay with best practice re employment practice . The local store should have spoken to HR at central office for guidance in handling this correctly . They should certainly be following the ACAS guidelines for disciplinary procedures . Your lad should have been written to and told the reason of the allegations against him and invited to a hearing and the opportunity to put his case forward to a disciplinary hearing panel if it warranted that . If he was summarily dismissed he should have been given a letter with a right to appeal Sounds like the local manager is doing their own thing and certainly not following good employment practice as communicated by their director of HR Liz bell . Interesting take on the defence lawyers using dementia as an excuse. Defence lawyers must have difficult time sleeping at night . We have had an individual up here , who has just got off with having obscene photos and videos of children ion his PC as the defence lawyer put forward a defence that others had used this paedo's pc or down loaded the extreme images Therefore the prosecution could not prove conclusively he had down loaded the under age videos etc . Case was not proven and dismissed still the 28 year old has admitted to having sex with under age kids and will be sentenced in due course the law is an ass at times -

CB Fry you really are one antagonistic person I have never said in my recent post there was a second side to the story . Clarksons admitted he had done wrong . It was he who reported it My comment was about the misinformation being released on the internet re the investigation and due process But you take pleasure as usual to try and belittle someone who has a differing view and who is very competent in dealing with disciplinary / grievances or bullying and harassment investigations Let's agree to disagree .

Verbal , I'm sorry to disappoint you. But I am certainly not confused. I wasn't saying the investigation was incomplete Just referring to the PDF that was in post 177. I don't doubt the prima facia aspects of clarksons behaviour, DPA and confidentiality have a major role in this sort of investigations I was just a tad surprised to see the article / part report in the public domain and to me it does seem incomplete . But maybe that is how the BBC do their disciplinary investigations. I am not really fussed if it is but there are slightly different models out there, CB fry . I'm not looking to find fault let alone trying to find something to get upset about . I leave that to the likes of you. All I was just alluding to was the process of investigating breaches of disciplinary rules in the work place. Sometimes it is never a straight forward process as there always two sides to a story. I am also aware that clarksons reported his behaviour to his bosses. You seem to take joy in mocking the likes of whitey and co. Why not just respect we have a different opinions and views than yours

Verbal I doubt you have any disciplinary investigation experience , maybe you have I don't know The Beeb letter about is a investigation summary according to the attachment , which is not complete that's why I said what I said There is no mention in the document to the specific allegations under the BBC staff rules and disciplinary procedures The report should have been redacted , as there is a potential breach of Data Protection . Re naming of staff , Etc Okay. Clarksons is a big name , but those are the rules in such normal disciplinary investigations. Witness statements are pretty sensitive information and will only be provided to the the alleged perpetrator of the breachl if they are going to a formal disciplinary hearing . So they can prepare their defence. Equally if a witness shares his or statement to others and compromises the investigation , they to could well have breach disciplinary rules. Any FOI received asking for a copy of the disciplinary report . Will only receive it in exceptional circumstances and then it will be heavily redacted. With names and sensitive information totally redacted. I deal with these matters on a regular basis. so do have a fair bit of experience. What I don't know is was this investigation done under the BBC disciplinary procedure or was it because clarkson had breach the terms of his Top Gear contract. I suspect it was disciplinary . As he had previously said he recieved a final written warning

CB sorry for being pedantic , but the spin you put on the assault suggests he was conveyed there by ambulance. It was later on in the evening that he drove himself to the nearest A&E some 50 miles away. So while he was wrong to have been assaulted . his split lip was not life threatening ,

Disciplinary hearings are not normally made public. Or is that another of one of those deliberatly leaked BBC documents. I wonder where the rest of the full report is .

I seem to recall before the TG investigation was completed that he would still appear on have I got news for you at the ENd OF April . A couple of weeks larger he is advised his contract with TG is not being renewed I suspect the BBC had different contractural arrangements with clarksons , may , and Hammond for different shows . The BEeb from what I read did not sack clarkson from the BBC .

I am quite concerned and very worried about sturgeon jumping into bed with millipede to for a coalition government She is one megalomaniac . In any other business where an employee was charged with such a crime, the likelihood is that the employee will immediately be marched from the premises and swiftly erased from company history. Patrick Rock was given a week to get his affairs in order before the OB even got a chance to arrest him. A cynical man might reflect that a week's grace might be awfully handy for limiting the scope of any incriminating evidence, but let's just leave such speculation aside and just say it was bloody irregular and that it wouldn't have taken the OB a week to nick a nonce on a sink estate. Pap , the employer would normally suspend someone in such cases where there is an ongoing investigation Like wise that maybe the case even if charge . The deciding fact is where the employee is found guilty and at the point the employee is well and truly like to be dismissed So by your viewpoint you would have expected Dave Jones to be Sacked when he was charged Deal with the Facts Pap instead of taking a blinkered approach to fuel your pro left wing and labour agenda

From an HR perspective I'm surprised in many aspects . That this has outcome has not be kept confidential unless some form of compromise agreement has been agreed . They don't say he has been sacked but contract not being renewed after it runs out next week . So in essence he has not been fired . I know it's a technicality . Punching An employee is an act of gross misconduct I guess there has been no formal disciplinary hearing just an agreement between the beeb and clarksons to leave I see North Yorkshire police are now looking into the case. The producer concerned apparently drove 50 miles to the hospital and then back again . As others have said no wonder A&E is clogged up . Dud the BBC not have a medical team on site as part of the production team ? Finally driving home this evening listening to 5 live and they were on about the guy from one direction leaving . Talking to all these fans etc asking how they felt , why they felt he left etc etc .
