LOL I did read it as I typed thinking that HMRC are not all rosey as the picture I seem to be painting. But in a case as high profile as this surly its in there best interest to play everything above board as if its proved at the inevitable appeal that they have fiddled the books to achieve a level in which they can screw someone over then the whole system is in trouble. If they get something wrong and it comes out in any appeal which would be the normal and correct process then corrections would be made and people would move on. The tax man is far from everyones friend but as much as most of us dislike paying our taxes at least we are pretty sure the tax man is only trying to get what the law says he is due. How would we feel if he went for more?

I think the judge will amend the CVA and ask for a proper SofA followed by a proper count of votes that are actually alloud to vote. This could take a while so aa and CHainrai will have a hissy fit and pull the plug claiming its all the taxmans fault.

I think the judge needs to decide if HMRC whacked the bill up to achieve the 25% or if aa did the same to make sure HMRC didnt reach 25%. Its difficult to imagine both happening and its even more difficult to imagine HMRC doing it deliberatly. What trust would the system have in them if they were to act in that way? My guess is HMRC have played by the book as it always has too. Its open to get things wrong but any wrong doings will or would be made in an honest way Pompey have proved time and time again that they are willing to flick the v's at whats right so where is the trust that they have acted in the right way this time? Not long to wait to find out though. still timme for me to bugger off home and set my self up for some coffee and toast.

As they are without a keeper at the mo maybe they are trying to show the judge both ends of there predicament. Cup finalists on the prems forwarded money but keeperless cause they released there rubbish keeper and englands number 1 walked away.

I agree with you, if it were anyone other than Pompy I would feel very sorry for the supporters as its a few dodgy people at the top that would have ruined it for so many. Ultimately I hope the judge sides with HMRC so proper messures can be taken against the previous owners and rules can be changed throughout football. I think the side with us or we are gone is a bit drastic as if the appeal fails Chainrai can take over, pull the club out of admin albeit with a points penalty and expect another WUP from HMRC. He might ultimatly have to pay out more as a result of that but he will have the club and be in a position much the same as we were, as in league 1 but with a way forward to push in the right direction. To be honest, if that was the path they chose to take in the 1st place they might not have seen so much resistance from HMRC. The blatent trying to f*ck over every man and his dog approach has in the end put them into this position. So right result for us tomorrow and Chainrai to still come to the rescue with a longer plan to get his money back than he hoped.

isnt this judge renowned for not getting his decissions overturned? TBH I dont think HMRC's QC did as well as we all hoped he would and it looks like there were a few opertunities for him to speak up and rubbish some of the things that went on. Early payment of parachute payments that were also included in the CVA being something that should really have been questioned. Even if it was proved it wasnt actual parachute payments it would still have made for some akward rambling from Poopy's QC. That said, we are only being fed snippets of what is actually going on so its hard to tell how things are really going. It sounds like HMRC managed to raise all the points we have all discussed and Poopy's QC managed to get a few questions raised about there own affairs too. On a whole my gut feeling is HMRC nearly screwed it but there are enough facts there to say the CVA wasnt done correctly and will therefor fail. I wonder if the judge can order amendments to the cva which would then make it correct and then for real votes to be couonted to see where we stand then?

Yeah ridiculas isnt it! If there was any truth in all the other interested parties then the closing statement was the best place to put them forward. "Judge, if you ratify the CVA we can proceed with securing one of the many interested party's that can be good for the club and its employee's!" rather than "Bin the CVA and we are fooked as the only person wanting to make some money out of us will walk away and sell the ground to get some money back or something!" Guess we wait till thursday around 3pm.

I cant believe there closing statement basically says approve the CVA so Chainrai can pick the club up for a snip or he walks away. Its like they are telling the judge that was Chainrai's plan the whole time and its down to the judge to sign it off!! Incredible!

There just seems to be so much contradictory evidence all over the place. I hope the written evidence thats been submitted is a little easier for the judge to decipher.

Just thinking about Scudamore's comments this morning (or when ever they were) If the PL had to step in to give some of the parachute payments in order for the club to finish the rest of the season, does that not mean they were trading whilst insolvent?

For a skate I actually look forward to some of your posts. Always pretty ballanced and understanding of the situation. Anyone will gladly take advantage of a situation if they can but not many will admit they would be in the wrong for doing so. Think had we got away without the - points we would have been glad to take advantage of the situation offered but there wouldnt have been many that would have been happy or bullish about it. You fall into the same bracket so have figured out that you must actually be a saint suffering some major colour blindness and directional disfunction.
